We should keep in mind that the last time sectional interests refussed to obey federal laws -- the 1860s -- there was a Civil War.

AR I think Trump has already started going down that path, he's been saying kind things about him knowing it will reach him trying to send a message you won't be threatened if you give up your nuclear weapons.

DD I do have a spare one. I was watching a programme today and they were discussing the forthcoming meeting between Turnbull and Trump. One of the people involved in the discussion said that he felt sorry for Turnbull because no-one has any idea what Trump would do or say. Therin lies one of the major problems with Trump.

Swan42: In general, state law does predominate, but not in areas such as foreign policy and immigration, policies which are overseen by the federal authorities -- both Congress and the President. Apparentlly, the relevant provision is:

Article 1 Section 8 Clause 4 which empowers Congress “To establish a uniform Rule of Naturalization.”

Last month 47 billion of trade was done between the US+ China.China purchased 10 billion of the US and the US purchased 37 billion of China.Thats a 27 billion deficit in one month.The Chinese must think there's only 1 Obama in a lifetime. From a Chinese point of view ,lol


The US has the advantage over China in that it is resource rich, China on the other hand must import most of its resources, the US is virtually energy self sufficient now, this does not harbinger well for the Chinese craving for more and more resources which is why they are preparing for greater power/expansion world wide. It has parallels with Japan in the 1930s.

A/R it is my understanding that State Law generally has precedence over Federal Law. That is very much where the "Tea Party" nuts come in. They basically don't won't any Federal Government involvement.

As for D Trump: he speaks at about grade 4 level and behaves accordingly.

Part VI of the Constitution. The supremacy clause contains what’s known as the doctrine of pre-emption, which says that the federal government wins in the case of conflicting legislation. Basically, if a federal and state law contradict, then when you’re in the state you can follow the state law, but the feds can decide to stop you. When there is a conflict between a state law and federal law, it is the federal law that prevails. For example, if a federal regulation prohibits the use of medical marijuana, but a state regulation allows it, the federal law prevails.

Bazza: correct; the yanks have big problems in regards whom actually runs what in the country. We know the law, but too many people disregard the law. Federal law bans 'weed', and yet, there are many different state laws. There is no doubt, as you pointted out, that federal law should always take precedence.

Then what is the federal law in the United States regarding the death penalty? Some states still have it while I am assuming most do not have the death penalty.

DD: The federal government does have the death penalty. Tim McVeigh was one executted using federal law.
